AquaSpot, LLC — Privacy Policy

AquaSpot, LLC (“AquaSpot,” “we,” “us”) operates the pool at the Soccer Asylum Sports Center in Paxton, Massachusetts and the website aquaspotma.com. This policy explains what information we collect, how we use it, and the choices you have, including how to opt in to and out of our emails and text messages.

1. Information we collect

Information you give us: name, email address, phone number, city and state, membership and class selections, emergency contact details, and messages you send us through forms, email, phone, or text.
Household members: names and ages of family members you add to a membership or open swim pass.
Payment information: processed by our payment provider Jackrabbit. We do not store full card numbers.
Insurance fitness program information: if you join through Silver Sneakers or a similar program, we receive and share the eligibility information needed to verify and bill your participation.
Automatic information: basic website data such as browser type, pages visited, and approximate location, collected through cookies and similar tools.

2. How we use it

To run your membership, schedule open swim, classes, and lane rentals, and process payments.
To send service messages: schedule changes, pool closures, billing notices, and safety alerts.
To send news, offers, and updates, only if you opted in (see sections 3 and 4).
To answer your questions, improve our services, and meet legal, insurance, and safety obligations.

3. Email messages

We send marketing email only to people who sign up or check the email box on one of our forms. Every marketing email includes an unsubscribe link and our mailing address. You can opt out at any time by clicking “unsubscribe” or emailing paxton@aquaspotma.com. We process opt-outs within 10 business days. Even after you opt out, we may still email you about your membership, billing, or safety.

4. Text (SMS) messages

If you check the text-message box on one of our forms, you agree to receive recurring text messages from AquaSpot LLC about schedules, closures, reminders, and promotions at the number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply.

To opt out, reply STOP to any message. You will get one confirmation and no further texts. You may also tell us any other reasonable way, such as by email or phone, and we will honor it.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties. Information may be shared only with the service providers that deliver our messages.

5. How we share information

We do not sell your personal information. We share it only with:

Service providers who help us run the business, such as our email platform Jackrabbit, texting platform Jackrabbit payment processor, and website host. They may use it only to provide services to us.
Insurance fitness programs you join through, as needed for eligibility and billing.
Legal and safety needs, such as responding to lawful requests, protecting swimmers and staff, or dealing with an insurance claim or incident.
A business transfer, if AquaSpot is sold or merged. Your information would remain covered by this policy’s promises.

We do not share your email or phone number with other businesses, including affiliated businesses, for their own marketing.

6. Children

Our website is not directed to children under 13, and we do not knowingly collect personal information online from children. A parent or guardian provides any information about children who use the pool.

7. How we protect information

We keep reasonable administrative, technical, and physical safeguards, consistent with Massachusetts data security regulations (201 CMR 17.00). We keep information only as long as needed for the purposes above or as required by law.

8. Your choices and rights

You may ask to see, correct, or delete the personal information we hold about you, or to stop marketing messages, by contacting us below. We will respond within a reasonable time. We may keep records we are required to keep, such as billing and incident records and a record of your opt-out.

9. Changes to this policy

We may update this policy. We will post the new version here with a new effective date. We will not use your phone number or email in a new way you did not agree to without asking first.
